1. DEFINITIONS; ENTIRE AGREEMENT.

In this Contract “Cruise” means the voyage for which passenger’s fare is payable, including all related shoreside excursions; “Vessel” means the vessel for the Cruise and tenders; “ACL” means the Vessel, its owners, operators, employees, agents, and charterers; “Passenger” means all persons booking or purchasing passage under this Contract, including you, persons in their care, and their respective heirs and representatives. The “Passenger Information” on the ACL website (www.americancruiselines.com) (the “Passenger Information”) in effect as of the date Passenger first pays any fare for the Cruise is hereby incorporated into this Contract as part of the parties’ agreement. This Contract, including the Passenger Information and payment receipts (the “Agreement Documents”), constitute the exclusive agreement between Passenger and ACL and supersede all other agreements, oral or written. If terms in other Agreement Documents conflict with terms of this Contract, this Contract shall control. The terms of this Contract are severable and if any shall be found unenforceable, the remainder shall be enforceable.

2. LIMITATION OF LIABILITY (BAGGAGE, PERSONAL PROPERTY); PROHIBITED ITEMS:

ACL’s liability for lost or damaged personal property is limited to the contents of baggage when transferred on or off the Vessel up to a maximum of $100 per passenger. ACL is not liable for Passenger’s lost, damaged, or stolen money, jewelry, electronic equipment (including cameras, computers, iPads, cellphones, etc.) or other items of value, or fragile or perishable items. In no event shall Passenger bring aboard the Vessel or check-in any flammable, explosive, weapon, or any other dangerous or harmful article of any kind, including illegal narcotic or other controlled substance. Animals of any kind may not be brought aboard the Vessel. ACL may refuse to permit Passenger to bring aboard the Vessel any item ACL deems inappropriate.

3. CHANGES:

ACL reserves the right to change, cancel or substitute any itinerary, vessel, stateroom, port of call, schedule, tour, excursion or duration of voyage at any time and for any reason whatsoever without prior notice (including reducing or extending days of voyage or continuing or finishing a voyage via other means of transportation) and shall not be liable for any claim whatsoever by Passenger for such change, including, but not limited to, loss, compensation, or refund, except Passenger shall be entitled to (i) a pro rata refund, calculated on a per day basis, of fare actually paid less applicable fees and charges, if a Cruise is cancelled or terminates early, and (ii) a refund of deposit actually paid to ACL for a tour or excursion, if that tour or excursion is cancelled.

4. SHORESIDE TOURS/SERVICES:

Shoreside or afloat tours or other services (collectively “Tours”) arranged by ACL are made solely for Passenger’s convenience and are at Passenger’s risk. The providers of Tours are independent contractors and are not agents or representatives of ACL. In no event shall ACL be liable for any loss, delay, disappointment, damage, injury, death or other harm whatsoever to Passenger arising out of or related to Tours, or by any airline, hotel, motel, ground carrier or any other provider of services, where utilized and/or offered incidentally to or in conjunction with carriage of Passenger aboard a Vessel.

5. HEALTH; DOCUMENTS; CONDUCT:

Passenger represents and warrants that he/she is fit to travel and that his/her conduct will not impair the safety of the Vessel or him/herself or others, nor inconvenience others. ACL, at its sole discretion, may refuse to carry or may land Passenger at any port, or transfer Passenger to any other means of transport, because of health or physical condition or because of conduct compromising safety of the Vessel or Passenger or others, or inconveniencing others, and Passenger hereby specifically releases ACL and the Vessel from any and all liability for injury or damage connected with the Cruise caused by Passenger’s pre-existing illness or disability or misconduct at any time. ACL shall have no responsibility to provide special services or equipment other than services or equipment required by law. Passenger shall comply with any government travel requirements and shall arrive aboard the Vessel by the time fixed by ACL. Passenger shall pay ACL on demand the cost of any loss, expense, damage, or delay, including any fine, penalty, duty, or other charge, sustained by ACL because of any act or omission of Passenger. Passenger agrees to abide by all ACL rules and regulations and all orders and directions given by ACL. Passenger agrees to a reasonable search of his/her baggage, person, and property, and to the destruction, removal or confiscation of any object which may in ACL’s sole opinion impair the safety of the Vessel or Passenger or others, or inconvenience others.

6. USE OF PHOTOS, VIDEOS, IMAGES OR RECORDINGS:

Passenger agrees and hereby grants to ACL the exclusive right to photograph, videotape, or otherwise record Passenger while aboard the Vessel, in port, or on Tours and include photographic, video and other visual portrayals of Passenger in any medium whatsoever for the purpose of advertising, publicity, trade or otherwise, without compensation to Passenger, and all rights, title and interest therein (including worldwide copyrights therein) shall be ACL’s sole property, free from any claims by Passenger or any person deriving any rights or interest from Passenger. Passenger agrees that he/she will not utilize any tape recording, video, or photograph(s) of him/herself, or any other passenger, crew, or third party aboard the Vessel, or depicting the Vessel, its design, equipment, or any part thereof whatsoever, for any commercial purpose or in any media broadcast, or for any other non-private use, without the express prior written consent of ACL.

7. MEDICAL ASSISTANCE:

Passenger acknowledges ACL is not a medical provider; ACL does not maintain a physician or infirmary on the Vessel; and the Vessel is equipped to provide only basic medical care for first aid to an injured or ill passenger until he/she can be evacuated from the Vessel to a shoreside medical facility, for which availability or evacuation may be limited or delayed due to the nature of sea travel and limitations of ports of call. Any medical services received by Passenger on or off the Vessel are at Passenger’s sole risk. Any medical personnel attending to Passenger on or off the Vessel, if arranged by ACL, are provided solely for Passenger’s convenience and shall not be deemed acting under ACL’s control or supervision. ACL shall have no responsibility for medical care provided ashore or its cost.

8. FORUM SELECTION CLAUSE; CLASS ACTION WAIVER; WAIVER OF JURY TRIAL:

It is agreed by and between Passenger and ACL that all disputes, claims, suits, and matters whatsoever arising under or relating to this Contract or Passenger’s Cruise, including travel to, from, and on the Vessel and any and all Tours or excursions ashore (each a “Claim”), shall be litigated, if at all, by Passenger individually and not as a member of any class, even if applicable law provides otherwise, in and before the United States District Court for the District of Connecticut, or as to Claims for which federal courts of the United States lack subject matter jurisdiction, before a court located in New Haven County, Connecticut, U.S.A., to the exclusion of the courts of any other district, county, state or country. ACL and Passenger IRREVOCABLY WAIVE TRIAL BY JURY in any such suit or proceeding. This Contract and any Claim shall be governed by federal maritime law. Passenger hereby consents to jurisdiction and waives any objection of venue or inconvenient forum he/she may have to any such suit or proceeding being brought in the applicable court located in Connecticut.

9. NOTICE OF CLAIMS; WAIVER; LIMITATIONS FOR SUIT; IN REM ACTION:

No lawsuit shall be filed or maintained against ACL for personal injury, illness, or death or for any other Claim unless (i) written notice of such Claim, with full particulars, is delivered to ACL’s principal office within six (6) months from the date of the event giving rise to the Claim, and (ii) a lawsuit as to such Claim is filed within one (1) calendar year after the date of the event giving rise to the Claim, and (iii) process for such lawsuit is served upon ACL within 120 days after such lawsuit is filed. If a Claim is for personal injury and claimant is a minor or mental incompetent, or if a Claim is for wrongful death, the foregoing deadlines for a Claim may be tolled until: the date a legal representative is appointed for the minor, incompetent, or decedent’s estate or three (3) years after the injury or death, whichever is earlier. Passenger expressly irrevocably WAIVES the benefits of all state or federal laws providing greater limitations periods for Passenger’s right to sue. Passenger hereby irrevocably agrees that the posting of a letter of undertaking from any of ACL’s insurers shall constitute adequate and appropriate form of security for the immediate release of the Vessel in any in rem proceeding against a Vessel.

10. LIMITATIONS OF LIABILITY:

ACL shall have no liability whatsoever to Passenger for damages for emotional, mental, or psychological distress or injury of any kind when such damages were not (i) the result of physical injury or actual risk of physical injury to Passenger or (ii) intentionally inflicted by ACL. ACL shall not be liable for, and Passenger solely assumes the risk of, injury, death, illness, damage, delay, breach, or other loss to person or property, or any other claim whatsoever by Passenger caused by act of God, war, terrorism, civil commotion, labor trouble, government interference, perils of the sea, fire, thefts or any other cause beyond ACL’s reasonable control, or any act not shown to be caused by ACL’s sole negligence. Passenger WAIVES all claims for consequential or punitive damages.

Oceania Club Benefits

All Oceania Club benefits listed are per stateroom, are based on double occupancy, can only be applied to one booking per voyage, have no cash value and are non-transferable. Unused shipboard credits and spa credits are non-transferable and non-refundable. To receive savings on the beverage package, purchase must be made prior to sailing. Savings on the beverage package only apply to Prestige Select package. Free Internet amenity does not include streaming. The complimentary custom air fee waiver does not include any air differential, which may be charged by the airlines. As of October 1, 2024 for sailings beginning January 1, 2025, silver level member guests and above tiers will receive a non-refundable shipboard credit instead of gratuities that are included in the cruise fare.

Oceania Club benefits and cruise credits do not apply to Travel Advisor promotional offers, including but not limited to Travel Advisor reduced rates and interline reservations. Oceania Cruises reserves the right to exclude or limit combinability with the benefits or rewards offered by other agency partnerships or promotional offers not specified here in. CruiseNext Credit (CNC), CruiseNext Haven Credit (CNHC) or Sixthman CruiseNext Credit (SCNC) (CNC, CNHC and SCNC may hereinafter be referred to as, collectively, or individually, a “Credit”) are issued by Goodwill Credit, Ltd. and are available for purchase on Norwegian Cruise Line and Sixthman sailings, as applicable. CNC and CNHC are only redeemable as payment towards new reservations on future Norwegian Cruise Line sailings. SCNC are only redeemable as payment towards new reservations on future Sixthman sailings. To redeem your CNC or CNHC, please call your Travel Professional or Norwegian Cruise Line at 1-866-234-7350 and advise you wish to apply your Credit to the reservation at time of booking.   2. When you purchase a Credit, your onboard account will be charged in US Dollars. The amount of your Non-Refundable Onboard Credit is based on the number of Credit(s) purchased and the Non-Refundable Onboard Credit promotional offering at the time of Credit purchase. The purchased Credit will be added to your Norwegian Cruise Line guest record (Latitudes Rewards account) within three (3) days of your sailing end date and will be added in the same currency you used to book the sailing you were on at time of purchase of the Credit. Currency exchange rates are set at the time of purchase.
  3. The Non-Refundable Onboard Credit given for purchasing Credit(s) on your current sailing will be used as payment towards for your final onboard bill for your current sailing and will be applied first to your Credit charge(s) before being applied to any other fees in your onboard account.
  4. CNC ($250 each) and CNHC ($500 each) are valid for sailings of three (3) days or longer. To redeem your Norwegian Cruise Line CruiseNext deposit(s) please call your Travel Professional or Norwegian Cruise Line at 1-866-234-7350. When purchasing a CruiseNext Deposit on a Sixthman cruise, you can purchase Sixthman CruiseNext deposit(s) which are only redeemable towards future Sixthman sailings. Or, purchase CruiseNext deposit(s) that are only redeemable towards future Norwegian Cruise Line Sailings.     1. When you purchase a CruiseNext Deposit (CND), your shipboard account will be charged in USD and you will receive an instant shipboard credit (listed on your final bill as Non-Refundable Onboard Credit) towards your current cruise. Once the cruise has concluded, the CND will be converted into the currency of your current reservation and your CND(s) will be added to your Norwegian Cruise Line guest record (Latitudes Rewards account). Currency exchange rates are set at the time of purchase. To change the currency of a CND; simply email cruisenext@ncl.com with your Latitudes Rewards number and request the currency for your new reservation. Guests who elect to use their CND toward a Sixthman event at the time of purchase will have their CND added to their Sixthman Username profile in USD.     2. You must be 21 years of age or older to both charge a CND to your shipboard account and to use on a reservation.
    3. A maximum of eight (8) CND(s) may be purchased per person.
    4. CND(s) are refundable only within 30 days of purchase, in the amount paid minus the amount of the instant shipboard credit (listed as Non-Refundable Onboard Credit) received. A CND can only be applied to a new reservation and otherwise has no cash value and is not redeemable or exchangeable for cash. CND(s) are transferable to another guest at no charge. Once transferred, new CND owner is subject to all CND terms and conditions. Original CND owner forfeits rights of ownership once transfer has been completed.
    5. CruiseNext Deposits ($250 each) and CruiseNext Haven Deposits ($500 each) are valid for sailings of 3 days or longer. CruiseNext Haven Deposits act as the full deposit for all staterooms onboard qualified sailings.     6. Limit of one (1) CND may be used per stateroom. You may apply two (2) CNDs to one (1) stateroom only when booking a cruise that qualifies for the DoubleUp! promotion. DoubleUp! promotion eligibility is based on redemption date and not on CND purchase date. DoubleUp! promotions may be subject to change and are subject to availablitly.     7. You must ask Norwegian Cruise Line or your Travel Professional to apply your CND(s) towards your new reservation. No black-out dates will apply. Reservations are subject to availability.     8. To cancel a reservation made with a CND, submit your request in accordance with Norwegian Cruise Line cancellation policies and procedures. Once a CND is applied to a reservation, it is subject to the same cancellation policy, rules and regulations as any other deposit which can be found on your reservation confirmation.

WINDSTAR FARE PRICE ASSURANCE POLICY: Guests who purchase a cruise on Windstar will be eligible for reimbursement upon request if the fare published by Windstar for their specific departure and cabin class is reduced after they have made a booking and deposit, and if the request is received by Windstar at least 120 days prior to sailing. The reimbursement will be provided in the form of a shipboard credit, upgrade, fare reduction, or a future cruise credit. Windstar will determine the form of reimbursement, and the amount of reimbursement will be the difference between the fare actually paid by the guest and the published fare on WindstarCruises.com the day the request is received. Guests who select reimbursement will be eligible for any complimentary inclusive features (e.g., hotels, air, tours) associated with the new fare and will forfeit any complimentary inclusive features associated with the original fare. All requests for reimbursement must be made directly to Windstar Cruises at 866-884-8032 (during regular reservations hours) at least 120 days prior to sailing. Windstar’s new fare pricing assurance policy will take effect with new bookings made on or after August 15, 2018. Windstar reserves the right to modify or terminate this policy at any time for bookings not yet made. Policy does not apply to certain promotions or guests outside of the US or Canada.

RESERVATIONS AND PAYMENT: Windstar Cruises works with travel agencies worldwide to serve your needs. Reservations either made by or assigned to a travel professional must be managed by the agency of record. While Windstar is unable to provide specific booking information on agency bookings, we are happy to answer general questions. Alternatively, you may reserve your cruise directly with us if you prefer. Since accommodations are limited by the number of staterooms or suites on each yacht, reservations should be made as early as possible. Payment for your Windstar cruise is to be made to the travel agency with which you made your reservation, or to Windstar Cruises directly. Travel documents will be issued when full payment has been received by Windstar Cruises. Refunds for cancelled or unused services will be made, less any applicable cancellation fees and charges. Your ticket is the Cruise Contract (available at www.disneycruise.com/cruisecontract). The forms needed for your vacation can be completed online by registering and logging into disneycruise.com and selecting “My Disney Cruise” or you will receive this package within 28 days of sailing. Carefully read your Cruise Contract, as it contains important terms and conditions which govern your cruise vacation and affect your legal rights. It must be signed by all Guests prior to embarking any Disney Cruise Line ship. In the event of conflict between the terms and conditions contained in the Cruise Contract, these Terms and Conditions, the terms of any Disney Cruise Line advertisement or offer, and the oral or written representations of any Disney Cruise Line representative, the terms and conditions contained in the Cruise Contract shall control.

MINORS
Minors under the age of 18 not traveling with a parent or legal guardian must be accompanied by an adult 21 years of age or older in the same stateroom. The parent or guardian of any minor not traveling with a parent or guardian must appoint an adult to have custody and control over the minor and to contract on their behalf in connection with the Disney Cruise Line vacation. A minor authorization form can be obtained by visiting disneycruise.com and selecting “My Disney Cruise” or is sent when a document package is mailed. The form must be signed by a parent or legal guardian prior to embarkation at the Disney Cruise Line Terminal. After 9:00 PM, adult entertainment districts are restricted to Guests 18 years and older.

BAGGAGE, VALUABLES AND OTHER POSSESSIONS
Each Guest may bring aboard the ship a reasonable amount of clothing and personal effects without charge, not to exceed 2 bags per person. All Guest baggage must be stored in the Guest’s stateroom and must be labeled with the Disney Cruise Line baggage tag. Dangerous or illegal articles such as weapons, explosives, liquid oxygen, combustible substances or nonprescription controlled substances may not be brought to Walt Disney World® Resort or taken aboard the ship. Any such items shall be surrendered to the Master of the ship at embarkation, and may be disposed of at the sole discretion of the Master. You should retain valuables such as cash, negotiable securities or other financial instruments, gold, silverware, jewelry, ornaments, works of art, photographic/video/audio equipment or supplies, laptop computers, cellular phones or other valuables in your personal control as Disney Cruise Line is not responsible for damage to or loss of these items.

ALCOHOL POLICY
Each Guest 21 years and older may bring two bottles of unopened wine or champagne (no larger than 750ml) or six beers (no larger than 12oz) onboard in carry-on luggage at the beginning of the voyage and at each port-of-call. All wine/champagne and beer brought onboard must be packed in the Guest’s carry-on luggage. Any alcohol packed in checked luggage will be removed and stored until the completion of the cruise. Guests are not allowed to bring liquors or spirits (including powdered alcohol) onboard.

DEPOSIT/PAYMENT INFORMATION
A deposit is required to confirm a reservation. Deposit amount will be determined at time of booking. Vacation and cruise packages are subject to cancellation if full deposit is not received in our office within the option period specified at time of booking. For reservations confirmed in U.S. Dollars, final payment in the form of a check or credit card (Visa®, MasterCard®, American Express®, Discover® Card, Diners Club®, Japanese Credit Bureau or Disney Visa® Card) must be received on the date determined at the time of booking. For reservations not confirmed in U.S. Dollars, acceptable forms of payment are Visa® and MasterCard®. Payment policy for group travel may vary. Please contact your Travel Agent for complete details. Failure to strictly comply with the deposit and final payment schedules, or any other applicable policies and procedures, will result in the automatic cancellation of pending reservations.
