PAVLUS TRAVEL SWEEPSTAKES
PARTICIPATION LIMITED TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND
THE DISTRICT OF COLUMBIA, 21 AND OLDER.
VOID WHERE PROHIBITED.
NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN.
This Sweepstakes is sponsored by Pavlus Travel & Cruise, Inc., 7510 Montgomery Blvd. NE, Suite 101, Albuquerque, NM 87109 (referred to herein as “Pavlus Travel” or “Sponsor”).
Eligibility. The Pavlus Travel Sweepstakes (the “Promotion” or “Sweepstakes”) is open only to legal residents of the 50 United States or the District of Columbia who are 21 years of age or older at time of entry. This Sweepstakes is void in all other U.S. territories and possessions, and where prohibited or restricted by law. Employees of Pavlus Travel, Azamara Cruises (“Prize Provider”), and their respective parents, affiliates, subsidiaries, vendors, licensees, advertising and promotion agencies and each of their respective officers, directors and agents, including Marden-Kane, Inc. (the “Administrator”) (collectively “Promotion Entities” or “Released Parties”) and their immediate family members (spouse, parent, sibling, grandparent and children, regardless of where they live) and persons residing in the households of such persons, are not eligible. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor/Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Noncompliance with any of the above eligibility requirements will result in disqualification.
Promotion PERIOD. The Promotion begins on January 1, 2025 at 12:00 a.m. Mountain Time (“MT”) and ends at 11:59:59 p.m. MT on February 28, 2025 (the “Promotion Period”). Sponsor’s designated computer is the official time keeping device for this Promotion.
HOW TO ENTER. To participate in the Sweepstakes, visit https://pavlus.com/azamara-sweepstakes-entry/ during the Promotion Period and follow the instructions to complete and submit the online entry form including providing your full name, address, city, state, zip code, mobile phone number and valid email address (“The Online Entry”). Limit one (1) entry per person/per day. Any entry information collected for/from the Sweepstakes shall be used only in a manner consistent with these Official Rules.
Random Drawing and odds of winning. A random drawing to select one (1) potential winner will be conducted on or about March 5, 2025, from among all eligible entries received. The random drawing will be conducted by the Administrator, an independent judging organization whose decisions are final and binding on all matters relating to this Sweepstakes. This is a randomized drawing that is not intended to and should not influence any decisions or actions for the benefit of the Sponsor. The Sweepstakes is in compliance with all applicable anti-corruption laws and regulations.
Winner Notification and Verification. The winner is subject to eligibility verification and will be contacted via email or phone (utilizing the contact information that was provided to Sponsor at time of entry). Potential winner will be required to execute and return an Affidavit of Eligibility/Release of Liability, a Publicity Release (where lawful) and a W9 form which will be used solely for tax reporting purposes (“Documents”). Completed Documents must be returned within 5 days (including Saturdays, Sundays and Holidays) of attempted delivery of same. If the potential winner cannot be contacted or fails to provide the requested information within the time period specified in the notification, said potential winner will forfeit his/her prize and Sponsor will have no further obligation to that potential winner. In the event that the potential winner is disqualified for any reason, an alternate potential winner may be selected from all eligible entries received. Prize voucher will be awarded within 2-3 weeks after winner verification is complete.
GRAND PRIZE: The Grand Prize includes one (1) Ocean View stateroom (double occupancy) on a 5 to 10-night cruise (based on winner selection from a list of pre-determined Azamara Cruise voyages) for winner and one (1) guest aboard a Azamara Cruise Ship (“Grand Prize” or “Prize”), subject to availability. Cruise is inclusive of items such as:
- Complimentary AzAmazin Evenings event
- Gratuities for housekeeping, dining and bar staff
- Bottled water, soft drinks, specialty coffees and teas, select standard spirits, international beers and wines
- Self-service laundry
- Shuttle service to/from port communities where available.
Transportation to/from Cruise point of embarkation/disembarkation is not included. Cruise must be taken by 12/27/2025, or Grand Prize will be forfeited. Total ARV of prize up to $5,818.
The Grand Prize will be awarded in the form of an Azamara Cruise Voucher and is subject to all Azamara Cruises terms and conditions located at https://www.azamara.com/about-azamara/legal . All other Cruise expenses, including but not limited to, taxes, fees, port expenses, airfare, ground transportation, pre- and post- cruise accommodations, shore excursion fees, premium dining, premium spirits, travel insurance, spa services, crew incentives, service charges, Wi-Fi, onboard expenditures, and any other incidental costs or other expenses other than the Cruise fare for two (2) individuals is the sole responsibility of Grand Prize winner and their guest traveling on the same itinerary. All travelers must possess required travel documentation (e.g., valid government photo ID, passport, as applicable). NOTE: Your passport and your guest’s passport must be valid at least six months beyond the dates of your trip. Winner’s guest requirements will be communicated at time of redemption. Sponsor will not be responsible for any cancellations, delays, diversions or substitution or any acts or omissions whatsoever by Cruise operator or any other persons providing any Cruise-related services or accommodations. Lost, stolen or damaged Cruise tickets, vouchers or certificates will not be replaced. All Prize details not specified in these Official Rules will be determined by the Sponsor in its sole discretion. Grand Prize is not transferable. No Prize substitutions permitted except at the sole discretion of Sponsor. Prize consists of only the items specifically listed as part of the Prize. Grand Prize winner will be solely responsible for any applicable federal, state, and local taxes and any other expenses related to the acceptance and use of a prize not specified herein. The value of the prize is taxable as income and winner will receive an IRS form 1099 for the value of the Prize as stated herein. In no event will more than the maximum stated number of prizes be awarded. No credit or monetary payment shall be payable to the Grand Prize winner by Azamara Cruises or Sponsor for unused vouchers or any unused portions thereof. The Azamara Cruise voucher may only be applied against the Cruise fare as set forth in Azamara Cruises contracts. Stateroom upgrades are subject to availability and Grand Prize winner and guest shall be responsible for any costs related thereto. No credits or refunds shall be provided for stateroom downgrades. Azamara Cruises cannot guarantee stateroom availability on date(s) of sailing requested by the holder of the Azamara Cruise voucher.
Cruises available on a space-available basis only. Available cruises may change at any time, subject to Azamara Cruises’ discretion. You must make reservations no more than 120 days prior to departure date. Proof of COVID-19 vaccination and/or negative COVID-19 test may be required to board the cruise, in Azamara Cruises sole discretion, as further described below. Other travel restrictions may apply.
Grand Prize or any of the above listed components may not be sold, traded, transferred, refunded, substituted, commissioned or redeemed for cash value. Cruise must be completed by 12/27/2025. Released Parties will not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by providing any of these services and accommodations necessitated by same.
Released Parties will not be liable for any loss or damage to baggage or other property of Grand Prize winner or guest. The Grand Prize winner understands and agrees that the Sponsor has the right, at their sole discretion, to disqualify and remove the Grand Prize winner and/or their guest from any activity at any time without compensation if the Grand Prize winner and/or their guest’s behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of the Released Parties or otherwise violates the policies of the Sponsor or Azamara Cruises and in such a case, the Grand Prize. Actual costs of Grand Prize package components will depend on point of departure, dates of travel and any difference in value will not be provided to the Grand Prize Winner. Grand Prize winner and guest must travel together on the same itinerary. Once travel dates have been booked, no extension or substitution of trip dates is permitted, except at Sponsor’s sole discretion. Once travel has been confirmed, any cancellation or change fees or restructuring of the trip are the sole responsibility of the Grand Prize winner.
Grand Prize winner and guest are solely responsible for providing all necessary identification documents and will be responsible for obtaining all necessary travel documents (i.e., valid passport, visa, etc.) and any fees or expenses associated therewith. Failure to provide such documents may result in trip cancellation upon airport/cruise check-in. Grand Prize trip conditions stated herein are not all-inclusive and may be subject to additional conditions, which may be stated in the Release and/or Grand Prize winner’s travel documents.
By accepting the Grand Prize package, the Grand Prize winner and their guest shall release the Released Parties from all liability and responsibility for payment of the Prize.
All parts of the Grand Prize are subject to availability, and subject to change or cancellation without written notice or warning. Sponsor may modify and/or restructure Grand Prize or portions thereof to comply with government orders or guidelines and Sponsor’s health and safety requirements. In addition, Grand Prize winner and their guest should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before traveling. Should the Grand Prize, or a portion thereof, become unavailable Promotion Entities shall make reasonable efforts to provide the winner with substitute experiences and/or items of a similar nature and value for that portion of the prize that is unavailable. If no substitute prize is reasonably available then the remaining components, if any, of the prize shall constitute full satisfaction of Promotion Entities prize obligation to the winner, and no other or additional compensation will be awarded.
Grand Prize fulfillment and related activities will take place on a date and time designated by Sponsor and only when and in a manner that it is safe to do so, as determined in Sponsor’s sole discretion in consultation with appropriate health and safety experts. Grand Prize winner and their guest must follow all instructions given by Azamara Cruise representative, at all times.
GENERAL CONDITIONS. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes if it cannot be executed as planned for any reason or event beyond Sponsor’s control, including but not limited to a Force Majeure event or occurrence, an “act of God” (e.g., natural disaster, etc.), weather delays or race cancelations, or an unforeseeable health event (e.g., pandemic) making it inadvisable, impractical, impossible or illegal or which materially affects a parties ability to perform its obligations under this agreement in whole or in part, or if fraud, technical failures, human error or any other causes beyond the reasonable control of the Sponsor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, at its discretion, award a prize from among all non-suspect, eligible entries received up to time of such action. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Released Parties assume no responsibility for undeliverable email messages resulting from any form of active or passive email filtering by a user’s Internet service provider and/or email client or for insufficient space in user’s email account to receive email. Released Parties are not responsible for computer, network, technical, printing, typographical, human or other errors, problems or malfunctions relating to or in connection with the Sweepstakes, including without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or in any Sweepstakes-related materials; or for any entries that are lost, misdirected, or fail to enter into the processing system for any reason; or are processed, reported, or transmitted late or incorrectly. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of prizes.
RELEASE. By participating, entrants/winner agree to release, discharge and hold harmless the Released Parties from and against any loss, claim or cause of action or liability of any kind, including but not limited to personal injury or death, resulting directly or indirectly, in whole or in part, from participation in this Promotion or from acceptance, use or misuse of a prize (including any travel/activity related thereto) or for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action, and agree to be bound by the Official Rules and the decisions of the Sponsor and/or Sponsor’s representatives, which are final and binding. This limitation of liability is a comprehensive limitation of liability that applies to damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or property, and claims of third parties. Entrants agree that the Released Parties have not made nor are in any manner responsible or liable for any warranty, representation or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to this promotion. Acceptance of a prize constitutes permission for the Sponsor and its agencies to use winner’s name and/or likeness for purposes of advertising and trade without further compensation, including a winners list, unless prohibited by law.
PRIVACY. Participation in this Promotion constitutes your consent for Sponsor to obtain, use and transfer your name, mailing address, email, phone number and other information to a third-party, including Azamara Cruises, for the purpose of administering this Sweepstakes and fulfilling prizes. Information collected from entrants is subject to Sponsor’s privacy policy at https://pavlus.com/privacy-policy/.
WINNERS. Winner will be posted at https://pavlus.com/pavlus-sweepstakes-winners-list/. The winner’s list will be available on or about March 31, 2025, or after winner has been verified.
PLEASE READ: IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION.
DISPUTE RESOLUTION, MANDATORY ARBITRATION, AND CHOICE OF LAW/JURISDICTION: This Sweepstakes is offered only in the 50 United States and the District of Columbia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants or the Promotion Entities in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Mexico, without giving effect to any choice of law or conflict of law rules (whether of the State of New Mexico or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Mexico. The Promotion Entities’ failure to enforce any terms of these Official Rules shall not constitute a waiver of that or any other provision. By entering, entrant agrees that whenever you have a disagreement with the Promotion Entities (individually or collectively) arising out of, connected to, or in any way related to the Sweepstakes, the Official Rules, or the Privacy Policies, you will send a written notice to the Sponsor (“Demand”). Entrant agrees that the requirements of this Dispute Resolution Section, defined as paragraph 8 of these Official Rules (“Dispute Resolution Section”), will apply even to disagreements that may have arisen before entrant accepted these Official Rules or the Privacy Policies. Entrant must send the Demand to the following address (the “Notice Address”): Pavlus Travel, 7510 Montgomery Blvd NE, Suite 101, Albuquerque, NM 87109, Attention: Marketing; with a copy to Administrator at Marden-Kane, Inc., 575 Underhill Blvd., Suite 222, Syosset, NY 11791-3416. Entrant agrees that entrant will not take any legal action, including filing a lawsuit or demanding arbitration, until 10 business days after entrant sends a Demand. This informal dispute resolution is in addition to, and does not waive, excuse, or supersede any pre-suit resolution process required by state or federal law before filing suit. Sponsor If the disagreement stated in the Demand is not resolved to entrant’s satisfaction within 10 business days after it is received, and entrant intends on taking legal action, entrant agrees that it will file a demand for arbitration with the American Arbitration Association (the “Arbitrator”). The Promotion Entities also agree that we will submit any and all disputes with entrant to arbitration before the Arbitrator. This arbitration provision limits the ability of entrant and the Promotion Entities to litigate claims in court and entrant and Promotion Entities each agree to waive their respective rights to a jury trial.
For any such filing of a demand for arbitration, entrant must provide proper service under the rules of the Arbitrator and notice to the Notice Address may not be sufficient. If, for any reason, the American Arbitration Association is unable to conduct the arbitration, entrant may file its case with any national arbitration company. The Arbitrator shall apply the AAA Consumer Arbitration Rules effective September 1, 2014, available at https://www.adr.org/sites/default/files/Consumer-Rules-Web_0.pdf (and as may be amended) and as modified by the agreement to arbitrate in this Dispute Resolution Section. Entrant agrees that the Arbitrator will have sole and exclusive jurisdiction over any and all disputes arising out of or relating to the Sweepstakes or any disputes with the Promotion Entities including, but not limited to, disputes as to the interpretation or application of this Dispute Resolution Section or the validity of the arbitration agreement herein. The Arbitrator has authority to issue any and all remedies authorized by law, except that any requests for the remedy of public injunctive relief shall be brought in a court of competent jurisdiction. The Federal Arbitration Act allows for the enforcement of arbitration agreements and governs the interpretation and enforcement of the agreement to arbitrate. The place of arbitration shall be Albuquerque, New Mexico.
Entrant agrees that it will not file a class action or collective action against the Promotion Entities, and that entrant will not participate in a class action or collective action against them. Entrant agrees that it will not join its claims to those of any other person. Notwithstanding any other provision in the Official Rules, or the privacy policies, if this class action waiver is adjudicated to be invalid by a court of competent jurisdiction, then the agreement to arbitrate is null and void, as though it were never entered into, and any arbitration dispute at that time will be dismissed without prejudice and may be refiled in court. Entrants irrevocably consent to the sole and exclusive jurisdiction of the state or federal courts of the State of New Mexico located in Albuquerque for any action, suit or proceeding arising out of or relating to this Sweepstakes. Under no circumstances does entrant or the Promotion Entities agree to class or collective procedures in arbitration or the joinder of claims in arbitration. The provisions of this Dispute Resolution Section shall survive conclusion, modification or termination of the Sweepstakes and suspension, revocation, closure, modification, amendments to the Official Rules, and any aspect of the relationship of entrant or the Promotion Entities relating to or arising from participation in the Sweepstakes.
